If You Need Legal Advice, Ask Experienced Memphis Dui Lawyers

Driving under the influence of alcohol (DUI) is a criminal offense in the United States. Any driver with a blood-alcohol concentration of over 0.08% (or 0.04% in the case of commercial drivers) is legally liable. This offense is usually considered a misdemeanor and is punishable by up to one year in jail. If, however, the defendant has been convicted for DUI many times or if he caused serious damage or injury, the conviction can be for more than a year. It is human to make mistakes, so it can happen to anyone to drink a few beers at a party and then drive their car. Should you find yourself in such a situation, however, you need the advice of one of the professional Memphis dui lawyers in order to avoid serious problems.

Having a good defense is essential when you are faced with a DUI prosecution, so be sure to be represented by experienced Memphis dui attorneys, who can handle the case properly. In the end, everything depends on lawyers, so it’s very important to choose wisely. Young people, especially, are tempted to drive while being under the influence of alcohol or drugs. They defy the law and rebel against it, to prove their independence and free spirit. Unfortunately, the state laws have zero tolerance for juvenile rebellion. Driving under the influence can cost you your driving license, unless you are defended by one of the skilled Memphis dui lawyers.

Should you be implied in a DUI incident, don’t panic. The first thing you should do is to find out as much information about state laws and your legal rights as you can. Contact one of the Memphis dui lawyers to help you, or you can look it up on the Internet. Statistics show that about half a million Americans are involved in DUI-related car accidents, so there are many chances that you will need the assistance of Memphis dui attorneys at least once in your life. The unpleasant consequences of these incidents can be loss of driver’s license, substantial fines, incarceration or house arrests. The best way to avoid these problems is, of course, to refrain yourself from driving after you have drunk alcohol. If you couldn’t help it, the only solution is to hire competent Memphis dui attorneys.

What exactly can Memphis dui lawyers do for you? Depending on the circumstances, they can check the case for errors, have samples analyzed, suppress irrelevant evidence, contest the loss of driver license and diminish penalties. In other words, Memphis dui attorneys will do their best to keep you out of jail and make sure your license won’t be suspended. DUI lawyers have seen plenty of similar cases and know the right defense strategy. They can get you out of trouble or at least negotiate a considerably reduced sentence.

It is said that it’s better to prevent than to suppress, so our advice is to try to avoid driving under the influence. This way you will avoid not only penalties, but also serious damage to the others and yourself. However, having one beer is not the same thing as being completely drunk. Therefore the punishment should fit the offense. We should not focus on punishing the one who has made a mistake, but on avoiding such mistakes in the future.

Do I Need A DUI Lawyer?

You've been arrested on a DUI charge. Now what do you do? Although most people will recommend that you hire a lawyer to represent your best interests many people do not do so, often because of shame and embarrassment. Whether or not you hire a lawyer can have a big impact on your case so you may want to think carefully before making a decision. If you do decide to hire a DUI lawyer there are several things to consider so that you find the best lawyer possible to represent you.

Because DUI laws vary among each state (http://www.duislawyer.com/stateduilaws), hire a lawyer that has expertise with the laws in the state where you were arrested. Also, hire a lawyer that specializes in DUI cases. Depending on where you live you may not be able to find a good lawyer that practices DUI law exclusively, but look for a lawyer who spends at least half of his or her time handling DUI cases. It may be tempting to hire your local lawyer who deals with a veritable buffet of issues such as DUI's, divorce, wills, and bankruptcy, etc. but DUI law is extensive and continually changing so you will likely be much better hiring a specialist in DUI.

Before you hire a DUI lawyer, or any other type of lawyer, meet with him or her first. Most lawyers will not charge you to meet with them while you're looking for someone to handle your case. Having a face to face meeting with your lawyer before hiring him or her is good for both the client and the attorney. You'll want to hire someone you feel comfortable working with. A face to face meeting helps you determine whether or not you feel comfortable. It also helps the lawyer decide if he or she feels comfortable working with you and wants to take on your case.

Before going to any consultations with lawyers (and you should consult with at least two lawyers before making a decision) do some research. The yellow pages is a good place to look for a lawyer but remember that the DUI lawyer with the biggest ad is not necessarily the best lawyer for you to hire. He or she is just the person with the biggest ad. You want a lawyer with DUI expertise and experience.

The library is another good place to do research. Your local library should have a copy of the Martindale Hubbell law directory. The directory does its best to list every lawyer in the United States along with his or her area(s) of speciality. You can search the directory by either location or area of law each lawyer deals with. The directory is also available online. People you know can also be a good source of information regarding a good lawyer.

Dui Lawyers Range in Skill

Dui Lawyers Range in Skill

As a DUI attorney, my job ranges from the mundane to the outright shocking. Some days are regular days at the office, others are spectacular days spent in front of juries or at police stations interviewing cops.

As DUI law becomes more and more strict throughout the nation, there are more and more attorneys who, because they see it as a lucrative opportunity, call themselves DUI attorneys. Having been at this now for nearly a decade, I have witnessed a range of practitioners. There are those who are so skilled at what they do that their craft or art borders on the sublime. There are others who couldn't even sell used cars, let alone advocate for an unpopular client in an unpopular cause.

With the advent of the internet, there is so much misinformation in regards to DUI lawyers. My first suggestion to anybody starting the long and painful process of a DUI charge is to read as much as you can on the subject. There are many good websites out there. I also highly recommend buying a book written by Larry Taylor, a top-notch DUI attorney in California. It is written for lawyers, but if you, as a layperson facing a DUI charge, read and understand it, you will be able to spot the swindler, and hire the wizard.

Is Hiring a Kentucky Dui Lawyer is Imperative?

Kentucky DUI Law: Kentucky uses two theories to find liability in drivers suspected of DUI. The first of these is the per se theory of intoxication. Under the per se rule, any person with a blood alcohol level that exceeds .08% is per se guilty of violating the state's prohibition against driving while intoxicated. The per se rule is a little tricky, since it does not take into account the state of the driver at the time of the arrest. Proof of per se intoxication is typically obtained through blood or breath testing, although the police may request a urine test if they believe it is the best means of ascertaining the arrestee's level of intoxication.

New bill would lower high blood-alcohol threshold for aggravated drunk driving in Kentucky. A member of the Kentucky State Senate has introduced legislation that would lower the blood-alcohol level for aggravated drunk driving. Kentucky drunk driving laws establish .08% BAC as the threshold of legal intoxication. Currently a BAC of .18% or higher is considered an aggravated offense subject to additional penalties. Senate Bill 71 would establish .15% BAC as the new threshold for aggravated DUI. Under the legislation, a highly intoxicated first offense driver would be required to spend a minimum of four days in jail. The bill also increases the penalties for drivers caught driving under the influence of drugs. The bill has passed the Senate Judiciary Committee and will soon be introduced to the full Senate of the Kentucky General Assembly.

DUI Penalties in Kentucky: The criminal penalties associated with driving under the influence in Kentucky become more severe with each offense a person accumulates. The look-back period is helpful in determining if an offender will face penalties for a first offense or a subsequent offense. The penalties for a first DUI offense in Kentucky are a $200 to $500 fine, a service fee of $250, 48 hours to 30 days in jail, not less than 48 hours and not more than 30 days of community service if the offender is eligible, driver’s license suspension of 30 to 120 days, and 90 days of alcohol or drug assessment and treatment. An offender is eligible for a restricted work permit after 30 days of a suspension. Second offenses result in harsher penalties including $350-$500 in fines, $200 in service fees, seven days to six months in jail, not less than 10 days and no more than six months of community service, one year of alcohol and drug assessment and treatment, and 12 to 18 months of license suspension. A third DUI offense in Kentucky results in penalties including a fine of $500 to $1,000, 30 days to 12 months in jail, not less than 10 days and no more than 12 months of community service, 24 to 36 months of license revocation, and one year of mandatory alcohol and drug treatment and assessment. A fourth DUI offense is a class D felony in Kentucky. The offender must serve a mandatory 120 days of a jail sentence that may be from one year to five years in length. The offender’s license will be revoked for 60 months and he or she will have to undergo alcohol and drug assessment and treatment for one year.

Kentucky DUI Lawyer: Kentucky considers driving under the influence a criminal offense that is punishable with both criminal and administrative penalties. Because driving under the influence can result in penalties that are difficult to face when you’re trying to live a normal life, hiring a Kentucky DUI lawyer is imperative if you have been arrested and charged with driving under the influence. Having a skilled Kentucky DUI lawyer representing you will give you the best chance for successfully defending yourself against these charges and keeping your reputation intact. Your Kentucky DUI/DWI lawyer will be familiar with the latest developments on DUI/DWI laws in the state, and can use this knowledge to provide you with the expertise you need to help you avoid costly fines, loss of licence, or even a custodial sentence.

A Sober Assessment

Anyone pulled over and arrested on a DUI (drunk driving) charge is certainly facing a serious offence and a marked record for ten years. Each year in the USA almost half-a-million people are injured as a result of DUI-related highway accidents. Perhaps, then, with the inevitable sequence of events running through your mind: loss of driving licence, vehicle impoundment, fines and local incarceration, you might be forgiven for thinking DUI=QED.

Ask a DUI lawyer, though, and you'll hear less about facing up to the inevitable consequences of your action, and much more about acting to protect your rights. Never afraid to make a drama out of a crisis, you will be strongly advised that inaction is simply not a viable option. Blighted by a DUI conviction record, and with your personal life in ruins, the last thing you want to be thinking is DUI=QED. In the doom-laden scenario now presented to you, fail to hire a DUI lawyer and you'll find DUI=RIP.

Let's introduce a little more light and less heat into the proceedings, and, hopefully, arrive at some judgement about when to engage the services of a DUI lawyer. This question can be looked at in two ways. You can either be broadly supportive of the DUI process, but feel you are the victim of an injustice owing to exceptional circumstances or procedural irregularities. Or you might be less sanguine about the entire DUI process, and feel a victim of a law which criminalises "normal" people unfairly. Which of these two views you hold determines, to a great extent, if and/or when you seek the services of a DUI lawyer.

During this symposium, the latest innovations to help out lessen the number of drunk drivers would be showcased. The list would include alcohol-detecting sensors and anklet devices. Consulting A Michigan Dui Lawyer

Avoiding a charge of DUI or driving under the influence is always the best course of action, but if you do find yourself facing charges under state DUI laws then you should hire a Michigan DUI lawyer as soon as possible to defend you. You can represent yourself but DUI cases are complex so hiring an experienced lawyer is advisable.

There is a lot of medical, technical and scientific evidence involved in a DUI case which includes the observations of the arresting officer, field sobriety tests which are carried out at the time of your arrest and the result of a blood alcohol test which will show the levels of alcohol in your system at the time. Interpreting and understanding these tests can be difficult, but a Michigan DUI lawyer will be able to understand these results and the potential implications.

The results of the tests and the evidence against you will form the basis of the prosecution’s case, it is the job of your lawyer to seek to present alternative explanations for the results and to disprove them. They may also look at the way in which the tests where carried out and whether correct procedures where followed and whether the personnel involved where qualified to carry them out. If neither of these were followed correctly then the applicable evidence could be deemed as inadmissible in court.

With DUI cases being so complex, hiring a lawyer is the best option, especially if you are unfamiliar with the law as it relates to your case. Your Michigan DUI lawyer will do far more than represent you in court as they will also manage the whole process for you including communicating with relevant parties and officials, obtaining copies of the evidence and ensuring all necessary paperwork is completed. To try to do all this yourself can become frustrating and stressful.

Finding a lawyer may not be as easy as you think but there are several options open to you. Firstly you should look for lawyers who specialize only in DUI cases as they will have the knowledge and experience to best handle your case. Recommendations from friends and family are always a good place start and you can also search online legal directories for lawyers in your local area. Finally, you can apply for a referral from the local bar association. You are under no obligation to hire their referral, but if you do you should be aware that the bar may charge you a fee for the referral.

Getting Your Dui Case Evaluated By A Michigan Dui

Anyone who is charged with a DUI offense (driving under the influence) in Michigan, should seek the services of an experienced Michigan DUI lawyer. An offense of DUI is taken very seriously and the penalties can have far reaching consequences, not just for you but also for your friends and family.

As most states will set their own laws with regard to offenses such as DUI, it is important to hire a lawyer who has knowledge of the law in which the offense occurred. If this is not your first offense for DUI then you will need to be aware of the severity of the penalty you are facing. Penalties for repeat offenses, committed in any state, will increase in severity with every subsequent conviction. First time offenders can usually expect penalties ranging from a fine to several days in jail, depending on the evidence in the case.

Build Your Dui Defense With An Experienced Michigan Dui Lawyer

If you are charged with DUI or ‘driving under the influence’ in Michigan then you will need to hire the services of a qualified Michigan DUI lawyer. DUI cases require expert knowledge of the scientific and medical evidence that is gathered in such cases and on which a successful prosecution of DUI is based.

Hiring an experienced Michigan DUI lawyer who specializes in DUI cases will give you the best possible chance of mounting a successful defense. It is important to note that not all lawyers will have experience of DUI cases and it is better therefore to hire one who only deals with charges of DUI.

Obtaining a successful prosecution in a DUI case can be as difficult as it is to successfully defend one. The strength of the evidence submitted and the way in which it was obtained is often the key focus for many defense lawyers, who may look to submit alternative theories for the results of the field tests or question the procedures used when the blood alcohol test was carried out. Either sides case will depend on upon sufficient doubt being cast about the driver’s ability or the strength of the evidence.

Your lawyer will attempt to question the legality of the evidence and present reasons why the judge should deem it inadmissible in court. This is why hiring a Michigan DUI lawyer is so vitally important as they will have the knowledge and expertise to understand and question this evidence.

If you are charged with a DUI offense then you should seek to hire a lawyer as soon as possible so they can begin building your defense straight away. The first consultation with many lawyers is often free of charge and can last up to an hour. This is your opportunity to question them on the knowledge and expertise they have in such cases, as well as asking about the consequences of the charges and the penalties should you be found guilty.

Those found guilty of a first time offense will usually face less severe penalties than those who have previous convictions, however this can change should serious injury or death have been caused as a result of DUI. Those with previous DUI convictions may seek to enter into a plea bargain whereby then entering of a guilty plea could lead to a lesser penalty being handed down.

The lawyer you hire will do far more than simply represent you in court. From the moment you hire them, they will work to manage the case for you, communicate with all relevant parties and officials and ensuring all the correct paperwork is submitted. DUI cases can be lengthy and frustrating and unless you have a keen legal knowledge yourself, should not be undertaken without the services of a lawyer.
